Announcing copyright termination calculator and website

Dear Readers,

I recently launched a sister website http://copyrighttermination.net that centers on copyright grant terminations, as the title suggests. The gem of the site is a copyright termination calculator, the design of which took more than a little time and a large amount of programming help. (Thanks!) The calculator will run a user through the questions and permutations necessary to evaluate when and under what conditions and statutory provisions a copyright grant may be terminated.

The program does not cover all the steps necessary to evaluate a potential termination. I haven’t tried to address the technical issues involved with accessing whether a majority of the author or authors is present to serve a valid termination notice.

The calculator does what it does well, though, and should be substantially more useful than some of the other similar programs on the internet. It cross references statutes and covers remote permutations such as the Copyright Office’s recent comment request on how to handle grants that were made before January 1, 1978 on works that were completed after January 1, 1978.

Weekly IP, Entertainment and Art Law Events

Dear Friends:

If you look at the top of the screen and sidebar you will see a new events widget and page. I find that I miss too many speaking events because I am either not informed or the date sneaks up on me. Case in point, today’s presentation on digital media that includes David Oxenford of Broadcast Law Blog fame. 

As a musician before law school, similarly, I was not aware of the services available from the legal community. I thought an events list might be my humble contribution to help remedy the situation. 

Let’s consider this a beta release: I haven’t spent enough time with the page to make it look pretty and this project may ultimately entail too much work. I also haven’t finished collecting all of the dates, especially from local and state intellectual property groups. If you would like to submit an event, please email me at events@senlawoffice.com. Or is it Presidents Day or President’s Day? I thought it’d be fun to take a brief pause to celebrate our forty-four (and a day off from work) with unintentional art. I’ll be back writing on copyright tomorrow. Here are a few images I’ve snapped with my iPhone over the past month or so.

And finally, this last image is a sign dating from the Great Depression. Movie theaters apparently used silverware and place setting giveaways as a way to attract women viewers during the time of financial hardship. The administrators at the Somerville Theater must have found the sign deep in their vaults. I personally would have selected the imported translucent china.

Exclusive Rights is now on facebook

There was a great WordPress plugin released recently that allows bloggers to stream an RSS feed on facebook using facebook’s new WordPress interface capabilities.  Pretty darn cool. If any of you prefer to follow Exclusive Rights on facebook and learn of new posts from wall updates, you can “friend” the blog at facebook.com/exclusiverights. How’s that for Web 2.0?

Friday fun: IP questions from the Philippines Bar Exam

One of the disappointments for U.S. law students who specialize in intellectual property is that there isn’t room on the bar exam for copyright or trademark questions; what with the need to cover 19th Century criminal and property law. This is apparently not the case in the Philippines. LAWPHiL has posted the questions from the Mercantile Law September 2009 Bar Exam, which featured a couple of fun IP questions.

You’re more than welcome to answer the questions in the comments. The winner will be openly ridiculed. The decision of the judges is final.

After disposing of his last opponent in only two rounds in Las Vegas, the renowned Filipino boxer Sonny Bachao arrived at the Ninoy Aquino International Airport met by thousands of hero-worshipping fans and hundreds of media photographers. The following day, a colored photograph of Sonny wearing a black polo shirt embroidered with the 2-inch Lacoste crocodile logo appeared on the front page of every Philippine newspaper.

Lacoste International, the French firm that manufactures Lacoste apparel and owns the Lacoste trademark, decided to cash in on the universal popularity of the boxing icon. It reprinted the photographs, with the permission of the newspaper publishers, and went on a world-wide blitz of print commercials in which Sonny is shown wearing a Lacoste shirt alongside the phrase “Sonny Bachao just loves Lacoste.”

When Sonny sees the Lacoste advertisements, he hires you as lawyer and asks you to sue Lacoste International before a Philippine court:

  1. For trademark infringement in the Philippines because Lacoste International used his image without his permission; (2%)
  2. For copyright infringement because of the unauthorized use of the published photographs; (2%) and
  3. For injunction in order to stop Lacoste International from featuring him in their commercials. (2%)
  4. Will these actions prosper? Explain.

  5. Can Lacoste International validly invoke the defense that it is not a Philippine company and, therefore, Philippine courts have no jurisdiction? Explain. (2%)

Hi Folks,

If you’ve visited Exclusive Rights recently outside of your feed reader, you may have noticed that the site has suffered a redesign by my not so able hands. One of the new features that may be of use is a widget on the right hand side of the site that allows you to search recent copyright decisions without having to run a search on the court dockets themselves.

If you’re like me, visiting the individual dockets and entering search limitations is a little bothersome.  The widget should — should being the operative word — automatically update the date field for the dockets that require you to limit searches, namely the UK/ECJ and Canada. I’ve included links to all of the major English language dockets except for India, which I’m still having trouble navigating, and the U.S., where you’re relegated to pay sites. I haven’t as of yet been able to get an automatic search to work with SSRN, so if any of you are able to code an end-around, please let me know.

If you have comments concerning errors, sources that should be added, or suggestions, don’t be a stranger. I’ve included the widget below so that you can take a test drive.
